Your Rights Under Maryland DUI Law

Perhaps the last thought going through your head once pulled over and suspected of driving while under the influence of alcohol is what your rights are.

In the state of Maryland, driving under the influence is a serious charge with serious consequences. When initially pulled over by a peace officer, you are required to show proof of a valid driver's license, the vehicle's registration and proof of insurance for the automobile. There is no law that requires you to answer any questions regarding your sobriety. Officers may pick up the scent of alcohol on your breath and/or see or hear slight speech impairments. Use short, simple answers like yes and no, or shake your head for yes or no answers. You also have the right to inform the arresting office that you want to engage your legal right to counsel.

Everything that you say and do in front of the officer can, and probably will, be used as evidence against you in the court of law. It is important to remain calm and polite when addressing the officer and the situation. However, remember you do have the right to legal counsel and the right to remain silent so as not to incriminate yourself any further with dialogue.

You also do not need to agree to take a field sobriety test. These tests are usually not a good idea to agree to take because they are often administered on the side of the road, at night and under a stressful situation, which can skew the results.
